The Dog Share Collective collects and uses personal information (“Personal Information”) to verify your identity, understand your needs, provide you with a better service and more widely to keep our wider community safe. You can use our services with total peace of mind. Respecting and maintaining your privacy and protecting your security is very important to us. Please read this Privacy Policy carefully to understand our practices.
1 Interpretation of Terms and Rules
1.1 This Privacy Policy uses the same definitions and rules as our Terms of Service.
1.2 This service is hosted and provided from within New Zealand. Please note that the Law of New Zealand governs this agreement and that all matters related to this agreement will be decided under the Law of New Zealand. By providing your personal data to us, you consent to the jurisdiction of the High Court of New Zealand and to be legally bound by the laws of New Zealand.
2 Acceptance of Terms of Service
2.1 It is important that you read this Privacy Policy in conjunction with our Terms of Service, as together they set out how The Dog Share Collective uses and protects any Personal Information that you give us when you use our Site. This Privacy Policy applies to your use of our website,
www.thedogsharecollective.com (the “Site”), all services and communications between you as a Member (“you”, “your”) and The Dog Share Collective (“Collective”, “we”, “our” or “us”), and all agreements entered into between you and us which involve the collection by, or disclosure to, or use and security of Personal Information, unless expressly provided otherwise.
2.2 We created this policy pursuant to the Privacy Act 1993 (NZ), and reserve the right to modify it from time to time to ensure our privacy practices continually meet or exceed all legal requirements. Modifications to this policy will be effective upon being posted on the Site and we will revise the "last updated" date at the top of this Privacy Policy to indicate this. You should review this page periodically to determine when this Policy was last
revised, as these will be binding on you. We will post a notice on our website to inform users that we have made changes to our privacy policy. You are responsible to familiarise yourself with the latest terms and conditions. Your continued use of the Site following any such modification(s) being posted shall be deemed to be your acceptance of such modification (s). If you do not agree with this Privacy Policy, please do not use our Site.
3 Privacy Policy
3.1 The Dog Share Collective is committed to protecting your privacy. Should we ask you to provide certain Personal Information, by which you can be identified when using this Site, then you can be assured that it will only be used in accordance with this Privacy Policy.
3.2 This Privacy Policy applies to all Personal Information collected by The Dog Share Collective on the Site. It sets out the basis on which any Personal Information we collect from you, or that you provide to us will be processed by us.
3.3 The Personal Information we collect depends on how our Services are used. Sometimes we receive your Personal Information directly, such as when your account is created, we receive an email from you, or a transaction is completed. At other times, we collect Personal Information indirectly by using technologies like cookies (“Cookies”) and web beacons (“Web Beacons”) to record your interactions with our Services (see clause 10). We also receive Personal Information from third- parties, such as verification services. The collection and use of data from a variety of sources is essential to our ability to provide our Services, and to help keep the Services and your online activity safe.
4 What we collect
4.1 By using our Site, you are agreeing without limitation, that we may collect and process the following Personal Information about you:
4.1.1 Personal Information that you correspond with us in connection with our Site or provide by visiting or registering on our Site which may be collected including your name, physical address, email address, IP address, phone number, Member user name and password;
4.1.2 Personal Information that you upload via content (“Member Content”) including photos;
4.1.3 Personal Information (not financial information) collected when you make a purchase including your credit card number and billing address;
4.1.4 Details of your visits to our Site including, but not limited to, traffic data, search criteria, location data and other communication data, and the resources that you access; and,
4.1.5 Personal Information automatically collected from your visits to our Site, which may involve the use of Cookies and Web Beacons which allow us to facilitate your convenient use of our Site and enhance your user experience.
5 What we do with your Personal Information
5.1 We collect and use your Personal Information to:
5.1.1 Create and manage your Membership account;
5.1.2 Process your transactions and manage your Member services;
5.1.3 Notify you about changes to our Site;
5.1.4 Ensure that content from our Site is presented in the most effective manner for you – your interests, preferences and technology;
5.1.5 Identify your uploaded Member Content as your content;
5.1.6 Exchange your Personal Information with other Members when a request to share is accepted;
5.1.7 Host online interactive areas and allow you to participate;
5.1.8 Communicate with you about your transactions, new products and services including transaction-related communications such as purchase confirmations;
5.1.9 Host surveys, competitions and choose prize winners;
5.1.10 Send you marketing emails to inform you of new services or offers that may be of interest;
5.1.11 Assist us in our business (for example with our planning and account management),
5.1.12 Assist with our legal obligations and requirements.
5.2 Please do not submit your Personal Information to us if you are not agreeable to our collection of it. We will always obtain your specific consent to being contacted for targeted marketing or research purposes (see clause 6.6).
5.3 We do not disclose Personal Information about identifiable individuals to our third-parties. We may however provide them with aggregate Personal Information about our Members which helps us reach the kind of audience we want to target for specific services to our Site.
6 Controlling your Personal Information
6.1 Consent of Your Personal Information. By submitting Personal Information to us, you acknowledge and agree that you have consented to the collection, use and disclosure practices set out in this Privacy Policy as they relate to your Personal Information.
6.2 We will not, without your consent, pass on any Personal Information you supply to us to anyone outside of The Dog Share Collective. You won’t receive spam communications from us and we’ll never share, sell or trade our Personal Information with external agencies.
6.3 Disclosure of your Personal Information. Except as set out in this Privacy Policy, The Dog Share Collective does not disclose your Personal Information to third-parties.
6.4 Occasions when we may disclose Personal Information to third-parties are limited to:
6.4.1 Disclosing your Personal Information to comply with any legal obligation, or in order to enforce or apply our other agreements including our Terms of Service; or to protect the rights, property, or safety of us, our Members, or others. This includes exchanging Personal Information with other companies and organisations for the purposes of fraud protection and credit risk reduction.
6.4.2 Disclosing your Personal Information to third-party service providers who perform services on our behalf. For example, we may hire other companies to handle the processing of payments, to provide data storage, to host websites, to fulfill orders and shipments, to assist in marketing, to conduct audits etc. These third-party service providers:
6.4.2.1 Shall be permitted to obtain only the Personal Information they need to provide the service;
6.4.2.2 Must protect Personal Information to the same extent as The Dog Share Collective; and,
6.4.2.3 Shall be prohibited from using it for any other purpose.
6.4.3 If we are acquired by a third party, all or substantially all of our assets may be transferred. In this case, as a Member your Personal Information about our Members and held by us will be one of the transferred assets subject to the terms of this Privacy Policy.
6.4.4 If we are to transfer your personal information to a third party as per this agreement, we undertake that the third party will hold your personal information on the same basis as we did and that such a third party will become a party to this Privacy Policy.
6.5 Your right to control and access your Personal Information. The Dog Share Collective respects your right to make choices about the use and control of your Personal Information. You may access and amend your Personal Information on the My Details tab of your My Account page. If you believe that any Personal Information we are holding about you is incorrect or incomplete, you are to advise Member Support Services (“Member Support Services”) (see clause 11.2).
6.6 Your right to control email marketing services. If at any time you decide that you do not want to receive marketing emails from us, please:
6.6.1 Check or uncheck the appropriate box on the Settings tab of your My Account page; and/or,
6.6.2 Unsubscribe from email communications using the link included within each email. Please note you will continue to receive transactional or account communications, but not marketing emails; and/ or,
6.6.3 Contact Member Support Services.
6.7 Accessing your Personal Information. The Privacy Act (1993) gives you the right to access all Personal Information held about you. To request the Personal Information that we hold about you, please request this in writing from Member Support Services (see clause 11.2). Please note a small fee may be payable for any access request to meet our costs in providing you with details of the Personal Information we hold about you.
6.8 Let us know immediately if you find the information we hold on you is not up to date or inaccurate. On receipt of the updated information or accurate information from you we will take reasonable steps to verify the new information and to update our database.
7 Security of your Personal Information
7.1 The security of your Personal Information is important to us. In order to prevent unauthorised access or disclosure to your Personal Information, we have put the following measures in place:
7.1.1 Personal Information collected online is only retained for only as long as it is reasonably required and for the purpose it was collected;
7.1.2 Access to your Personal Information is limited to those of only those members of our team who require it, to provide services to you. All our team members sign confidentiality agreements to protect Member and other confidential Personal Information;
7.1.3 All Personal Information collected online is secured and safeguarded using industry standard (without limitation) suitable physical, electronic and managerial procedures;
7.1.4 All Personal Information is stored in secure computer systems which protect it from unauthorised access or use;
7.1.5 All payments via our Site are processed using Secure Socket Layer (SSL) protocol, which means all sensitive Personal Information is encrypted and stored securely (see clause 9.2); and
7.1.6 All third-party service providers are required to sign confidentiality agreements to maintain the confidentiality of your Personal Information and not to use it for any unauthorised purposes.
7.2 Finally, please note that while we strive to protect your Personal Information, we cannot guarantee its absolute security because no method of electronic storage or transmission over the internet is 100% secure. For this reason, any transmission of your Personal Information to our Site by you is at your own risk.
8 Interactive Areas
8.1 Our Site includes interactive areas, in which you or third-parties create, post or store any content, messages, comments, materials or other items on the Site in interactive areas. If you use an interactive area, you should be aware that these areas are open to the public and any Personal Information you post or provide on your profile may be viewable by others.
8.2 We are not responsible for Personal Information you submit in connection with the interactive areas, nor are we responsible for how others might use that Personal Information, including postings or sending you unsolicited messages. Interactive Area postings may be retained indefinitely. If at any time you would like to remove a posting, please contact Member Support Services (see clause 11.2). Please note that removal of a posting from an interactive area does not mean that the posting will be deleted from our system.
8.3 For the avoidance of any doubt, any reference in this Privacy Policy to your Personal Information shall include Personal Information about other individuals that you have provided us with. We may collect and process Personal Information about others that you provide us with, including (but not limited to) Personal Information that you provide by filling in forms on the Site.
8.4 For the avoidance of any doubt, we do not intend to solicit or collect Personal Information from anyone under the age of 18. Members only may
use or enter Personal Information on this Site, including without limitation, any interactive areas of the Site. The minimum age of our Members is 18.
9 Links to other Websites
9.1 Our Site may contain links to and from other websites of third-parties. We cannot be responsible for the protection and privacy of any Personal Information which you provide whilst visiting such sites, as these sites are not governed by this Privacy Policy and that we do not accept any responsibility or liability for these policies. Before you submit any Personal Information to these websites, you should exercise caution and become acquainted with their Privacy Policy prior to use.
9.2 Stripe. Our Site uses Stripe Inc. as your payment service provider because when you enter your credit card data into the payment form it is never sent to our server. Instead, the data is sent directly to Stripe which holds PCI compliance. This is important because it increases your safety, as we don’t handle any sensitive credit card data on our servers, it’s more secure, and a breach of our servers won't result in any stolen credit card data. Your Personal Information will be handled by Stripe in accordance with their Privacy Policy.
10 How we use Cookies and Web Beacons
10.1 The Dog Share Collective uses Cookies and Web Beacons to enable us to deliver more personalised, user-friendly and relevant services to you.
10.2 A Cookie is a small text file that is placed on your hard drive or device. Cookies contain Personal Information that can later be read by a web server in the domain that issued the Cookie to you. The Personal Information that Cookies collect include the date and time of your visit, registration, session identification number, navigational history and your preferences.
10.3 A Web Beacon is a similar type of technology that may be used on our Site and in promotional e-mail messages or newsletters. When you click on a link on a page with a Web Beacon, we may record your response to customise our offerings to you. Web Beacons allow us to measure the actions of a Member to assist us in determining how many Members have visited and opened certain pages to improve user experience
10.4 Combined these Cookie and Web Beacon technologies enable us to:
10.4.1 Protect your security and prevent fraud by checking your login details (“Login Details”);
10.4.2 Remember your previous database searches and preferences to dynamically deliver more personalised and relevant content to you;
10.4.3 Provide you with access to interactive areas (see clause 8.1);
10.4.4 Record your activity on our Site, such as pages visited, emails clicked, forms opened and products and services purchased to improve the customisation of our services to you; and,
10.4.5 Identify new members arriving at the Site via a referral from an affiliate website or sponsored link.
10.5 You have the ability to accept or decline Cookies. Please be aware that the Site is however optimally designed to operate with Cookies enabled in your internet browser. Most browsers automatically accept Cookies, but you can modify your browser setting to decline Cookies. If you choose to decline Cookies, you may not be able to use the interactive features of our Site and services that depend on Cookies, but you will be able to perform basic navigation through the Site.
10.6 This privacy policy covers the collection of Personal Information and use of Cookies by The Dog Share Collective only, and does not cover the use of Cookies or other technologies by third-parties to collect Personal Information
